5.6.3.2 Federal Rules and Law

Rules 26(a)(2) and 26(b)(4) of the Federal Rules of Civil Procedure govern the discovery of experts. Rule 26(a)(2)(A) requires the disclosure of the identity of any person who may be used at trial to present evidence under Rules 702, 703, or 705 of the Federal Rules of Evidence. Federal Rule 26(a)(2)(B) requires that any expert retained to provide expert testimony shall prepare and sign a written report that contains a complete statement of the expert’s opinions, the bases of those opinions, exhibits that will be used to support those opinions, qualifications of the expert, publications authored in the last ten years, the compensation to be paid the expert, and a list of other...
