B. (§5.37) Drafting of Legal Descriptions

Generally, the legal description need not be technically accurate for the instrument to be operative, but the description must sufficiently identify the property to enable a surveyor to locate the property and distinguish the conveyed property from all other land. Weber v. Johannes, 673 S.W.2d 454, 458 (Mo. App. S.D. 1984). Using lots in or reference to recorded plats to describe property conveyed is generally limited to urban areas; in rural areas, legal descriptions are commonly referenced by metes and bounds or the United States Government Survey System.
