§ 5.10.5 Exigent Circumstances/Emergency Aid Entry

In State v. Aguilar, 28 Ariz. 401, 267 P.3d 1193 (2011) (Div. 1), the court of appeals noted that a warrantless entry of a motel room would be lawful under the exigent circumstances exception “only if both probable cause and exigent circumstances existed.” The entry in this case was unlawful because, although officers possessed probable cause, there was insufficient exigency.
