In this wrongful death case, the plaintiff estate of the decedent, on behalf of his 13-year-old daughter, asserted that the defendant driver struck the decedents vehicle with such force that it caused fatal injuries to the plaintiff's decedent. The defendant stipulated liability but contested the plaintiffs damages. On September 24, 2016, the plaintiffs deceased was traveling westbound on West Sample Road in Coral Springs. The defendant was traveling southbound on North State Road 7 when he entered the ramp to go westbound on West Sample Road. The plaintiff contended that, instead of completing the right turn, the defendant negligently failed to control the vehicle and recklessly crossed over the median, colliding with the decedents vehicle. The plaintiff alleged that the force of the impact resulted in the necessity to extricate the decedent from the vehicle and he died approximately 40 minutes later. As a result of the collision, the decedents minor child claimed past and future pain and suffering. The plaintiff was 13 years old when her father was killed. At trial, she was 21 years old. During the trial, the jury heard testimony about the very close and strong relationship between the father and the plaintiff, his only daughter. The plaintiff testified about the connection she had with her father as well as how his death has affected her. She described how her love of art and her artistic talent came from her father. The plaintiff's mother also testified about the close relationship between the father and the plaintiff. She described that when the plaintiff found out about her father being killed in the car accident, she cried for days and did not eat or sleep much. The plaintiff started wearing his clothes and stopped spending time with friends. She was angry much of the time and told her mom she was waiting for her dad to come back. She saw a psychologist after the decedent died and continued seeing a psychologist until COVID. The mother further testified that the plaintiff still talks about her father every day and that her pain is growing as she gets older.
