4.9 INTERLOCUTORY AND EARLY APPEALS—JURISDICTION

Federal appellate courts have jurisdiction over certain interlocutory appeals as of right under 28 U.S.C. § 1292(a) and over certain permissive interlocutory appeals under 28 U.S.C. § 1292(b). The collateral order doctrine, recognized in Cohen v. Beneficial Industrial Loan Corp. ¹⁰² as an application of the final order rule found in 28 U.S.C. § 1291, permits early federal appellate review in small class cases.
