4.4:210 Cross-Examining a Truthful Witness; Fostering Falsity
There are no Arizona authorities that specifically address the possible application of ER 4.4 to trial tactics, such as the cross-examination of an adverse witness. In Arizona, the permissible scope of cross-examination is quite broad. Unlike its counterpart in the Federal Rules of Evidence, Rule 611(b) of the Arizona Rules of Evidence does not limit the scope of cross-examination to matters covered in the witness's direct testimony, but permits it to be conducted "on any relevant matter."
