4.4:101 History of Amendments
2003 Amendments. The 2003 amendments added a new paragraph (b) that governs what lawyers should do when documents are inadvertently transmitted to them. The amendments to ER 4.4 went further than the similar amendments to MR 4.4, in that ER 4.4(b) requires the receiving lawyer to preserve the status quo for a reasonable period of time after notifying opposing counsel of the receipt of the document(s).
