4.3.4.2.3 Bonded Stop Notice

Stop notices come in two forms: (1) bonded stop notices and (2) nonbonded stop notices. A bonded stop notice is available with respect to stop notices served on construction lenders, not those served on others. A construction lender served with a nonbonded stop notice may withhold sufficient monies to respond to the stop notice; and a lender served with a bonded stop notice must withhold sufficient funds to respond to the stop notice.
