The text of ER 4.2 is virtually identical to that of MR 4.2, with the exception that Arizona retained the reference to communications with "a party," while the Model Rule refers to communications with "a person." Comment [3] to ER 4.2, however, roughly defines "party" as a "person." ER 4.2 cmt. [3]. The Comments to ER 4.2 differ from the Comments to MR 4.2.
