A. New York State Human Rights Law⁹⁵

The state Human Rights Law prohibits, inter alia, discrimination in the provision of housing on the basis of disability.⁹⁶ It mirrors many of the antidiscrimination protections contained in the FHAA, including the duty to make reasonable accommodations.

There has been less case law concerning claims of housing discrimination under the Human Rights Law since passage of the FHAA, primarily because the FHAA provides broader protections and remedies for the plaintiff or complainant. Bringing a complaint solely under the Human Rights Law may have other disadvantages. An election of remedies is required.
