§ 38.3.3 Types of Administrative Proceedings. A.R.S. §§ 41-1092 to 1092.12, the Uniform Administrative Hearing Procedures (UAHP), set forth administrative appeal and hearing procedures for most state administrative agencies. In 1998, Title 45 was amended to require ADWR to conform to the procedures now found in the UAHP. At the same time, a new section was added describing how Title 45 interfaces with UAHP. A.R.S. § 45-114. Throughout Title 45, references are made to A.R.S. § 45-114 to clarify the administrative process before ADWR. ADWR adopted procedural rules in 1984, former A.A.C. R12-15-201 to 224, but, with two exceptions, these rules have been allowed to expire as they were largely superseded by UAHP. ADWR continues to follow A.A.C.
