§ 35.3.5.7.1 Child Care Facilities. A child care facility must be licensed if it receives compensation to provide care, supervision, or training for five or more children not related to the proprietor of the facility. A.R.S. §§ 36-881(3), 36-882(A). But see A.R.S. § 36-884 (exemptions from licensing for certain facilities). The license application procedure is outlined in A.R.S. § 36-882. See also A.A.C. A child care facility will receive a regular license from ADHS if ADHS is satisfied, after an inspection of the facility and its activities, that the facility is in substantial compliance (as defined in A.R.S. § 36-881(8)) with the requirements of Title 36, Chapter 7.1, Article 1, and agrees to carry out an acceptable plan to eliminate any deficiencies. A.R.S. § 36-882(E). ADHS will issue a provisional license that is valid for no more than six months to permit time for a licensee to correct deficiencies if a facility is unable to conform to ADHS’s standards, but does not threaten the health or safety of children and the immediate interests of children, families, and the general public are best served by issuing the provisional license.
