§ 32-43 Products Liability - Design Defect - Strict Liability

In an action based on strict liability, where a design defect is alleged, the plaintiff must prove the product, as designed, was in a defective condition unreasonably dangerous to the user when it left the control of the manufacturer and the defect caused his injuries. The focus is on the condition of the product, without regard to the action of the [seller] [manufacturer].
