§ 31.3.4.12.1 Taxation of Costs. Costs “may be awarded defendant agency if a judgment adverse to the plaintiff is rendered.” A.R.S. § 12-912. This statute appears to give the superior court discretion whether to award a prevailing agency its costs against the plaintiff.
