F. Posting of Cash Bail or a Bail Bond

The procedures for posting cash bail or a bail bond are found within CPL § 520.30. Pursuant to that section, the court is authorized to conduct a hearing to determine the reliability of the person posting cash bail, or the value and sufficiency of any security offered, and “whether any feature of the undertaking contravenes public policy.”⁴⁶⁹ The actual examination of the sureties rests with the trial court, not the appellate courts, and the People’s offer of proof setting forth reasonable grounds to believe that the person posting the bail is not in rightful possession of the money, or that such money is the fruit of criminal conduct, is...
