§ 3.2.2 ARCAP 25 Sanctions. ARCAP 25 authorizes imposition of sanctions on an attorney or a party if the appellate court determines that an appellate motion or the appeal itself is frivolous or was filed solely for purposes of delay, or for a violation of the ARCAP rules. See also A.R.S. § 12-2106; DGP Trucking Co. v. Fopa Trucking Co., 26 Ariz. App. 195, 198, 547 P.2d 47, 50 (1976). See generally Attorneys’ Fees §§ 11.2.1.3, 11.2.10. ARCAP 25 also provides that the appellate court may impose upon offending attorneys or parties sanctions that are appropriate in the circumstances of the case, and to discourage similar conduct in the future.
