§ 3.2.19 On-Call Time. Whether the time is referred to as on-call, show-up or standby, it will be compensable or noncompensable depending upon the employee's freedom of movement at the time. If employees must remain on the employer's premises or so near that they cannot use the time freely, the time is compensable. However, if employees can come and go freely, and engage in personal, social, or recreational activities, even though they must leave a telephone number where they can be reached or carry a pager or beeper, the time can be excluded from hours worked.
