28.3 Introduction. Arizona recognizes two forms of tortious trespass: (1) trespass to chattels (i.e., personal property); and (2) trespass to land (real property). Arizona law criminalizes trespass to land in various degrees based upon the type of real property upon which a defendant trespasses.5 Arizona law also contains criminal offenses analogous to trespass to chattels with regard to certain types of personal property.6
