28.1382(A) Driving or Actual Physical Control while Under the Extreme Influence of Intoxicating Liquor

The crime of driving or actual physical control while under the extreme influence of intoxicating liquor requires proof that:
The defendant [drove] [was in actual physical control of] a vehicle in this state; and The defendant had an alcohol concentration of [0.20] [0.15] or more within two hours of [driving] [being in actual physical control of] the vehicle; and The alcohol concentration resulted from alcohol consumed either before or while [driving] [being in actual physical control of] the vehicle.
