27.11 Attorneys’ Fees – A.R.S. 12-341.01(A). The duty not to interfere with a contract of another arises out of law, not contract.⁷⁸ An attorney fee award under A.R.S. 12-341.01(A) is not permissible if the claim at issue arises out of the breach of a duty imposed by law rather than by a contract.⁷⁹ Therefore, fees under the statute are not permissible for a tortious interference claim.
