§ 26.05 POST-TRIAL PROCEDURES

[1] Necessity and Benefits of Findings of Fact

In cases tried to the court, the court must find the facts specifically and state separately its conclusions of law. Judgment is to be entered pursuant to CR 58 and may be entered at the same time as the entry of the findings of fact and conclusions of law. CR 52(a)(1). Findings of fact and conclusions of law are specifically required with respect to final decisions in adoption, custody, and divorce proceedings, or when findings of fact and conclusions of law are otherwise required by statute. CR 52(a)(2). A written opinion or memorandum decision is sufficient if it includes formal findings of fact and conclusions of law. CR 52(a)(4).
