24.7 OTHER CLIENTS

Not many courts have dealt with the power of constituents to waive the privilege in other institutional settings.

One court has held that an accounting firm's partner can waive the firm's privilege. ¹³⁵ On the other hand, in the well-publicized governmental case against KPMG, a court held that only KPMG could control that partnership's privilege. ¹³⁶
