1. Consider Whether Appropriate

A written post-trial motion is not appropriate in every case. Such motions can involve a great deal of time and expense to the client and, therefore, should not be made unless there is a specific reason for doing so, beyond mere dissatisfaction with the verdict.

In deciding whether to bring a post-trial motion, counsel should consider the following:
