IV. Federal Practice Compared

The Federal Rules of Civil Procedure governing post-trial motions differ from the New York State rules in several respects. Counsel unaccustomed to the rules applicable in a particular federal court should thus review the applicable provisions of the federal rules and of the local court rules before the start of trial.3448 The basic federal framework is set forth below, with some of the key differences from state practice highlighted.
