§ 22.2.5 Bail and Deposits. The magistrate is required to permit the collection of bail, or acceptance of bail bonds, for and on behalf of the Court. A.R.S. § 22-242(C).

The magistrate also is required to designate a person and a specific location and hours at which that person will accept, for and on behalf of the court, deposits for civil traffic violations. A.R.S. § 22-424(C).

The magistrate must prepare a schedule of civil traffic violations, listing specific deposits for each violation, and ensure proper deposits are accepted for and on behalf of the court. Id.

The magistrate is further required to prepare a schedule of traffic violations not involving the death of a person or any felony traffic offense, listing specific bail for each violation. A.R.S. § 22-424(B)(1). The bail schedule statute excludes felony DUI from the list of bailable offenses, and it has been found to not violate the due process rights of a felony DUI defendant to gather exculpatory evidence.
