22.12 Stairs. It is clear that a plaintiff who misuses a stairwell—for example, by vaulting over the banister—cannot recover, even if it is in a defective and dangerous condition.¹³⁹ Beyond this, a landowner may be liable for injuries occasioned by steps where there is an “unusual change of elevation,” such that it cannot be seen by persons on the premises—in one case, a single step down in the middle of an otherwise-flat sidewalk—or where it is not visibly marked.¹⁴⁰
