The plaintiff in this vehicular negligence action sustained serious
injuries when her vehicle, which was lawfully proceeding through
an intersection, was struck by the defendant who entered the
intersection against a red light. The defendant denied all allegations
of negligence and injury.
On July 21, 2016, the male plaintiff was driving north in the1000 block of
Sawyer Street at its intersection with Washington Avenue in Houston, Texas.
The defendant was driving west on the 2400 block of Washington. As the
plaintiff passed through the intersection of Sawyer and Washington with a
green light in his direction, the defendant failed to stop at the red light in his
direction, entered the intersection and caused a major collision.
The plaintiff maintained that the defendant was negligent in failing to keep a
proper lookout, failing to apply the brakes in time to avoid the collision, fail-
ing to apply the brakes in a timely manner, failing to stop for a red light and
driving at an excessive rate of speed. Following the accident, the plaintiff
was diagnosed with cervical, thoracic and lumbar sprain and strain, bilateral
wrist sprain, left knee pain, headaches, and pleurodynia, a sharp pain in the
side usually located in the intercostal muscles and believed to arise from
inflammation of fibrous tissue.
The court found in favor of the plaintiff and awarded the plaintiff past medi-
cal expenses of $56,004.26, future medical expenses of $45,500 and past
and future pain and suffering of $200,000, for a total of $301,504.
