21.14.2 Governmental Immunity. Many of the common law immunities have been abrogated in whole or in part. Although blanket sovereign immunity, which protected the state from all suits, has been abrogated,⁴⁵⁰ remnants of sovereign immunity live on in the form of legislatively granted immunities. A.R.S. § 12-820.01 describes those situations in which the state, its subdivisions and its employees have absolute immunity. They include the exercise of a judicial or legislative function, and the exercise of an administrative function involving the determination of fundamental governmental policy. Since governmental liability is the rule in Arizona, legislative enactments which create immunity are to be narrowly construed.⁴⁵¹
