§20.3 RIGHTS PROTECTED

§20.3-1 Generally

Employees are guaranteed the right to engage in or refrain from engaging in self-organization, collective bargaining, and other concerted activity for the purpose of collective bargaining or other mutual aid or protection. ORS 663.110.

The right to refrain from participating in a labor organization is limited by a union security exception. Employees may be required to pay standard union initiation fees and dues as a condition of employment but may not be required to actually join a union and become subject to its constitution and bylaws. ORS 663.110. In employment subject to National Labor Relations Board jurisdiction, this relationship is referred to as financial core membership or agency shop.
