A. Answer to Complaint/Response to Petition

1. If service made pursuant to request to waive service of summons, must file and serve Answer 60 days from date Request to Waive Service was sent, or 90 days if addressed to defendant outside of United States. For Family Law cases, Response is due 20 days from date Acceptance is filed with the court, or 30 days from date Acceptance is filed with the court if acceptance was made outside of Arizona.

RULE:

If service of the summons has been timely waived upon request under Rule 4.1(c) or 4.2(d), Waiver form must be returned within 30 days after request was sent, or within 60 days if sent outside of any judicial district of the United States. Answer must be filed and served within 60 days after the date when the request was sent, or within 90 days after that date if the request was addressed outside any judicial district of the United States. In Family Law cases, time for filing Response to Petition is 20 days if service is accepted in Arizona and 30 days if service is accepted outside of Arizona.
