2.8 MISCELLANEOUS LIMITATIONS ON DISCOVERY

2.801 Limitations in Specified Proceedings. In proceedings for separate maintenance, divorce or annulment of marriage, eminent domain, and for a writ of habeas corpus or in the nature of coram nobis, the Rules limit the scope of discovery "to matters which are relevant to the issues in the proceeding and which are not privileged." ²⁶³ The effect of this limitation on the scope of discovery is unclear, since the rule closely parallels the general rule in other civil cases allowing discovery of "any matter, not privileged, which is relevant to the subject matter involved in the pending action." ²⁶⁴ In proceedings...
