b. (§2.73) Irrevocable Trust
If a MO HealthNet applicant is deemed to have established an irrevocable trust, then the trust must be analyzed to determine whether any of the trust assets could possibly be used for the benefit of the settlor/applicant or spouse. In other words, for analysis purposes, there are two types of irrevocable trusts:
1. Those in which the trust assets are available to the settlor
2. Those in which the trust assets are not available to the settlor
