§ 2.6 Books and Records of Planned Communities

A.R.S. § 33-1805 (A) requires “all financial and other records” ²²⁰ of the condominium association to be reasonably available for examination by any member or person designated by the member in writing as the member’s representative within 10 business days of a request for examination. The planned community association cannot charge more than $0.15 per page ²²¹ for copies of the requested records. The association cannot charge a member or the member’s designee for making the material available for review. This would include record retrieval costs and the cost of physically making records available or providing a contractor or employee to sit with an owner conducting an examination or inspection.

A.R.S. § 33-1805 (A) is not clear on whether there is a requirement that a community association mail records to owners who request them, or whether the community association is only obligated to mail the records to an owner who examined the records in person and then requests copies to be provided after the in person examination.
