2-4 Proving Non-Florida Lawyer's Amenability to Suit

The complaint must identify the particular provision of the long-arm statute that supports an assertion of personal jurisdiction over the non-Florida lawyer.53 The defendant can contest the existence of personal jurisdiction by filing a motion to dismiss accompanied by an affidavit.54 The burden then shifts to the plaintiff to refute the defendant's position by means of its own affidavit.55 If the competing affidavits cannot be reconciled, an evidentiary hearing is held.56
