2-4 Proving Non-Florida Lawyer's Amenability to Suit

The complaint must identify the particular provision of the long-arm statute that supports an assertion of personal jurisdiction over the non-Florida lawyer.⁵³ The defendant can contest the existence of personal jurisdiction by filing a motion to dismiss accompanied by an affidavit.⁵⁴ The burden then shifts to the plaintiff to refute the defendant's position by means of its own affidavit.⁵⁵ If the competing affidavits cannot be reconciled, an evidentiary hearing is held.⁵⁶
