§ 2.4.4 Owner Right to Information when Accused of a Violation

A.R.S. § 33-1803 imposes requirements for the mandatory exchange of information when an owner is in violation of the governing documents. Before the planned community can take action against the unit owner to enforce the provisions of the planned community’s documents regarding the “condition of the owner’s property” (e.g., maintenance, weeds, constructing a change without approval, etc. but specifically not assessments), the planned community must provide the owner written notice of the violation. Written notice is therefore required before filing a lawsuit for injunctive relief or using “self-help” to remedy a violation.
