§ 2.3.8 Federal Court Jurisdiction. Several exceptions to preemption are stated in the NLRA. These involve Section 301, Section 303, Section 14(b) and Section 10(a). Section 301 of the NLRA provides that the federal courts have jurisdiction in "suits for violations of contracts between an employer and a labor organization representing employees in an industry affecting commerce as defined in this Act, or between any such labor organizations. . . ."⁴⁰ In Textile Workers Union v. Lincoln Mills,⁴¹ the Supreme Court held that in Section 301 suits, the courts were told to fashion a body of federal substantive law based upon the policy of the national labor laws, using judicial inventiveness if necessary.
