§ 2.19 For Sale Signs

A.R.S. § 33-1808 (F) states that, regardless of what the community’s documents say, planned community associations cannot prohibit the “indoor or outdoor display” of a for sale sign and a “sign rider” by a unit owner on that owner’s “property,” including a sign that indicates the owner is offering the property for sale by owner. The association cannot charge a fee for the use or placement of a for sale, for rent or for lease sign. Although it is clear from the legislative history that A.R.S. § 33-1808 is intended to allow “for sale” signs regarding the sale of the home or unit, known as “real property,” the use of the word property raises the possibility that a person could place a “for sale” sign on “personal property” such as an old refrigerator or furniture.
