§ 2.14 Political Signs and Political Petitions

A.R.S. § 33-1808 (C) places limitations on a planned community’s ability to restrict political signs. A “political sign” for purposes of A.R.S.
§ 33-1808(C) is defined as follows:

A sign that attempts to influence the outcome of an election, including supporting or opposing the recall of a public officer or supporting or opposing the circulation of a petition for a ballot measure, question or proposition or the recall of a public officer.

Under A.R.S. § 33-1808 (C), a planned community shall not prohibit the indoor or outdoor display of a political sign on an association member’s property. Despite the above prohibition, a planned community can prohibit the display of political signs earlier than 71 days before the day of an election and later than three days after the election. A.R.S. § 33-1808(C) does not empower a planned community to restrict political signs outside of the 71 days before and three days after an election.
