Board Unanimously Opposes Senate Confirmation of Judicial Appointments
Summary of Board of Governors Action January 25 1980

Two items dominated the meetings of the executive council and board of governors on January 25-26:

1. After a spirited debate between Representatives Ronald H. Strahle and Charles B. Howe, and Senator Ralph A. Cole, and a report from Charles J. Traylor of the association's judicial selection and tenure committee, the board unanimously rejected the provision in HCR 1002 to provide for Senate confirmation of judicial appointments. At the same time, the board approved other provisions in the concurrent resolution which would permit more public input into the judicial appointment process without destroying the basic integrity of non-partisan merit selection.

2. After another extensive presentation by members of the Supreme Court grievance committee and Norman E. Berman as chairman of the association's grievance policy committee, the board narrowly rejected by 20-19 vote the revisions to the disciplinary rules proposed by the official committee which would remove confidentiality from the formal disciplinary hearings after a finding of probable cause. The vote accepted the association committee's report providing, along with other non-controversial recommendations for modification in the official committee's revision, that the disciplinary process be opened to the public upon the filing of recommendations for disciplinary action with the Supreme Court, rather than at the trial level.


Other Board Actions

a. Approved a resolution asking the General Assembly to meet the budget requests of the Judicial Department for adequate court-appointed counsel funds.

b. Approved a parallel resolution calling for more adequate funding of the Public Defender system.

c. Reiterated its support for a bill to provide for a specific judicial salary increase this year and adoption of an escalator clause to provide for annual increases for judges as for other state employees.

d. Reiterated its opposition to a bill (SB 73) which would surcharge traffic offenders an amount in addition to their fines for support of a law enforcement training program.

e. Approved a resolution proposed by the Denver Bar Association calling for assistance in solving the other funding problems...
