Summary of Board of Governors Action

Sept. 26, 1979

At its short meeting prior to the convention in Colorado Springs on September 26, 1979, the board of governors urged that no piecemeal amendment regarding penalties under the new sentencing law be made until after an evaluation of experience under the present act. In the same resolution, the board also reiterated its 1978 recommendation that a state commission be established to make a continuing study of the classification and definitions of crimes and sentencing practices thereunder.

The board also adopted the report and standards for appointment of counsel for indigent criminal defendants, in the absence of public defender availability, first suggested to the Supreme Court in January 1979 by the special criminal appointments court liaison committee, but with the substitution of the somewhat less stringent qualification requirements embodied in a Pueblo County Bar Association resolution of September 11, 1979.

Action on a related matter was taken by approval of a new ad hoc committee to work with the General Assembly's joint budget committee and other legislators in seeking adequate funding for the judicial department to compensate court-appointed counsel in both criminal and civil cases.


Other Board Actions

1. Approved in concept the proposal of the family law section for a long-arm statute in dissolution of marriage cases, but sent back to the section the specific legislative proposal for improvement in language and form and resubnission to the board in January.

2. Reiterated its stand in support of carryover basis repeal in the Federal tax law and of a budgetary allotment to cover expenses of an appearance by a CBA representative before Congressional committees considering such legislation.

3. The United Bank of Denver having withdrawn from the national student loan program, thereby terminating the CBA's agreement to maintain at least $100,000 of its surplus funds in that bank, the board agreed that the association may now invest such funds wherever it can obtain the best return, and directed the...
