Meeting of March 26, 1977

  1. Decided to take no action at this time on HCR 1007 for a constitutional amendment to raise the popular vote requirement for retention of judges to 60%, because legislative interim committee created in 1976 to study possible changes in judicial merit selection provisions of constitution has asked for authority to continue its study and its future recommendations may result in fragmented constitutional amendments being proposed which, in any event, cannot be voted upon by the people until the general election of 1978.

  2. Recommended to board of governors that the forms manual be published with the understanding that the forms committee in the future will work up all forms in accordance with the January board resolution.

  3. Decided to take no action on SB 325 purporting to outlaw closed panel prepaid legal service plans, but asked the availability of legal services committee to study the practical and legal implications of the bill in its present form as amended.

  4. Approved a revised Continuing Legal Education memorandum of understanding with DBA, DU and CU and authorized the president to sign in behalf of CBA, with the understanding that the annual contribution of $5000 will not take effect until the next fiscal year and that the CLE board of directors will consider the request of the CBA treasurer that a different method of calling for these funds, if needed, be developed.

  5. Resolved that the executive council in behalf of CBA vigorously supports and endorses legislation which clarifies the Colorado Sunshine Act to exclude from the term "lobbying" those activities or communications which are the practice of law as defined and regulated by the Supreme Court (SB 21).

  6. Reaffirmed its prior position not to become a party or amicus or contribute funds for legal expenses in the lawsuit CAPE et. al. v. Buchanan, No. C-61298 in the Denver District Court, involving the Colorado Sunshine Act.

  7. Approved as bar-supported legislation SB 161 concerning the sales tax and relating to the definitions of "sale" or "sale and purchase," as well as an unnumbered...
