The executive council at its meeting on December 17, 1976 more largely was concerned with monitoring bar activities than with taking interim action pending the mid-winter meeting of the Board of Governors in Denver on Saturday, January 29, 1977. Nevertheless the following actions were taken:

  1. Approved funding of normal operations of prepaid legal service corporation through meeting of the Board of Governors on January 29 out of the additional $20,000 previously authorized by the board, with the effect that if the Board then decides to terminate all support, thirty days notice to employees may be given January 31 for wind-down by February 28.

  2. Approved the recommendation of the criminal law section that the CBA petition for right to file an amicus curiae brief in A, B, etc. v. District Court, on certiorari to U.S. Supreme Court No. 76-506 from Supreme Court of Colorado 550 P.2d 315 (1976), on the narrow question of where, in anticipation of civil litigation, privileged communications enter into the work product of the lawyer, such work product should not be reachable by grand jury subpoena, it being understood that the chairmen of the criminal law and litigation sections are to consult and report back to the president on the possibilities of having such a brief prepared on a non-fee, pro bono basis.

  3. On recommendation of the chairman of the public relations committee, authorized the president, president-elect and immediate past president, or any two of them, with the advice of public...
