Board Urges Adoption of Merit Selection System for Federal Judges

A broad resolution urging the application of a merit selection system to the appointment of federal judges, and directing the judiciary section to evaluate and report at the next regular meeting of the board in January 1977 on desirable modifications in the federal process, was adopted by the governors at its September 29, 1976, pre-convention meeting in Colorado Springs.

At the same meeting proposals for bar-sponsored legislation in the 1977 General Assembly were given a mixed reception:

1. Approval was given to a fat report of a special committee of the corporation banking and business law section making extensive revisions in the uniform commercial code which basically has remained unchanged since its adoption in 1965.

2. Approval with some amendment was given to the two sections of the proposed revision to the Colorado Probate Code, tabled at the Vail meeting in August, but deleted from the final bar-sponsored bill, was a section which would have expanded powers of attorney to include authorization to terminate life-support measures in hopeless cases, assigning this problem to other appropriate sections and committees for further study.

3. Again tabled was specific legislation proposed by the traffic courts committee creating a new traffic offense of inattentive driving, providing for assessment of penalty points by judges, and decriminalizing Class 3 and 4 traffic offenses, although the latter concept was approved but without the use of nonjudicial personnel therefor.

4. Tabled for redrafting and clearance with the probate and real estate sections was a proposal of the uniform state laws committee for bar-sponsorship of a uniform act governing disclaimer of transfers under nontestamentary instruments.


Other Board Actions Prior to the 78th Annual Convention

1. Authorization to the taxation law section to prepare a position paper and testimony for presentation at a November 8, 1976, hearing on revised regulations under the sales tax statute proposed by the state director of revenue, and to circulate this information to board members prior thereto, with authority to present same if no substantial objections are received, and to refer areas of controversy to the executive council for decision.
