To Look at Many Areas Affecting Lawyers

The Board of Governors of the Colorado Bar Association has approved seven new pieces of legislation and will consider several more in January. The Uniform Probate Code got strong endorsement ("B" rating) and has also been favored by an interim legislative committee, chaired by Rep. Ron Strahle (R-Ft. Collins) who will serve as the new chairman of the House Judiciary Committee. This bill calls for far-reaching changes in probate practice.

The Board also approved ("C" rating) a rewrite of the Business Corporation Code that would delete the fee schedule based upon the size of the corporation, permit a majority (instead of two-thirds) vote on the sale of all corporation assets, and award attorney fees in stockholder suits without reasonable cause, to mention only a few substantial changes.

Other "C" rated bills are three remedial proposals on charitable trusts, inheritance taxes and dispositions of community property; amendments to the Dissolution of Marriage Act and a massive Mental Health Bill---a two-year drafting effort of the CBA's Mental Health Committee.

Further requests for Board action include the Uniform Alcoholism and Treatment Act, several no-fault auto proposals, four or five new judgeships, a third division of the Court of Appeals to deal with criminal cases and upgrading of judicial compensation. A special non-bar committee appointed by Gov. Love is working on judges' pay and will report to the general assembly.
