Board of Governors: April MeetingBoard Supports Defense for Criminally Accused, Approves Forms Publication and $220,735 Budget

The traditional role of lawyers to represent criminally accused on whatever fee basis, if any, can be provided was reaffirmed by the CBA Board of Governors at its spring meeting in Boulder on April 22. In response to an inquiry from the Supreme Court, which acknowledged the need for assigned counsel when the public defender has a conflict or overload, but pointed out the limited appropriation for reimbursing counsel in these situations, the Board went on to strongly support the proposition that the quality of service should not be affected by the amount of fee, if any, paid to the attorney.

To publish and distribute a revised version of approved forms, the Board authorized an advance from surplus of $8,400 with the expectation that the project would eventually be self-liquidating on the basis of a pre-publication price of $5.00 and a regular price of $7.00 for the estimated 150 pages of forms expected to be available by the end of June.

In other actions at the all-day meeting, the Board

1) Converted the old executive committee into an enlarged executive council with full power to act for the association between board meetings;

2) Approved a record budget of $220,735, including $80,600 for publication of The Colorado Lawyer, but coupled the latter appropriation with a directive that a continuing effort be made by the publications committee, under the close supervision of the executive council, to reduce costs;

3) As part of the budget, approved an appropriation of $8,000 for the Association's share in printing an estate planning handbook (the additional $10,000 cost of which has been advanced by the Denver Trust Officers Association and Colorado banks), provided that a detailed distribution plan be presented to the executive council for recovery of costs on much the same basis as for the forms book;

4) Approved the recommendation of the joint management committee that a bylaw be drafted providing that no project involving the expenditure of funds exceeding $1,000 should be presented to the board without prior comment from the auditing and budget committee as to the fiscal impact...
