17.9 Damages. A plaintiff may recover both compensatory and punitive damages on an abuse of process claim.68 Compensatory damages can include attorneys’ fees spent on defending the underlying matter in which process was misused, costs associated with damage to personal and professional reputation, and costs from medical care arising from emotional distress.69
