A. (§17.4) Employers
An employer is defined as “[e]very person, partnership, association, corporation, limited liability partnership or company, trustee, receiver, the legal representatives of a deceased employer, and every other person . . . using the service of another for pay.” Section 287.030(1), RSMo 2016. Any school, township, county, or political subdivision is also an employer. Section 287.030(2).
Generally, employers subject to this provision must have at least five employees. Section 287.030(3). But construction industry employers only need to have one employee to be subject to The Workers’ Compensation Law (the Law), Chapter 287, RSMo. Id. Employees are defined as “every person in the service of any employer, as defined in this chapter, under any contract of hire, express or implied, oral or written, or under any appointment or election . . . .” Section 287.020.1, RSMo Supp. 2018. The following are examples of employees under the Law:
· Family members of an employer
· Minors
· Sheriffs and deputy sheriffs
· Corporate and executive officers
