B. (§17.37) Statutory Judicial Foreclosure

The procedure for statutory judicial foreclosure is found in §§ 443.190–443.280, RSMo 2016, which authorize any mortgagee to commence the action by filing a petition in the circuit court in the jurisdiction in which the real estate is located. Although § 443.190, RSMo 2016, is susceptible to various interpretations, it appears prudent to include as defendants:

• the original mortgagor;
• any persons who have assumed the indebtedness;
