VI. Criminal Facilitation—Agency Defense Inapplicable
The agency defense is relevant only to a charge of selling drugs. It is inapplicable to the crime of criminal facilitation—knowingly aiding the commission of a crime without necessarily possessing the mental culpability required for the commission of the crime itself and thus not within CPL § 60.22’s definition of an accomplice.
