3. (§17.20) Fraud by an Employee
In State v. Birkemeier, 927 S.W.2d 503 (Mo. App. E.D. 1996), the appellate court reversed dismissal of fraud charges against an employee who claimed that her alleged on-the-job injury prevented her from engaging in various activities. After a physician ordered Birkemeier to refrain from working for three months, the employer hired private investigators to conduct video surveillance of Birkemeier. Without her knowledge, the investigators videotaped her engaging in various physical activities.
